A new handbook has been developed to help families understand the value of and how to create a Henson Trust, which can help them support a family member with a disability. The booklet was sponsored by Reena, a community services provider for people with developmental disabilities, and the Law Foundation of Ontario.
A Henson Trust is a legal tool used to financially support a relative with a disability who receives Ontario Disability Support Program (ODSP) benefits, without affecting those benefits. A trust is one way that families can provide some money for a relative, so that they can continue to receive ODSP. The trust money can help the individual cover additional costs they may encounter, such as necessary goods and services, or holiday expenses.
Written in plain language, the booklet covers the basics of receiving ODSP benefits, how Henson Trusts can be used to support those receiving benefits, and detailed instructions on how to set up a trust. The handbook also provides information about financial and estate planning, and answers common questions about wills and estates.
